🧵Assessment on re-opening of a permanent residence application: In Xu v. Canada (MCI) 2024 FC 839, the Court  held that when an administrative decision is reopened, the re-assessment cannot be done in abstract and must take into consideration all relevant factors.

Abuse of process due to delay: In Teklay v. Canada (MPSEP) 2024 FC 843, Justice Turley stated that abuse of process must be raised at the tribunal stage. Failure to do so may preclude it from being raised on judicial review:
